CONSTITUTION OF THE OLD ORDER MOTORCYCLE CLUB

- NAME
1.1 The organization shall be known as the “Old Order Motorcycle Club” and referred to as “Old Order MC”.
1.2 The trademark consisting of the name “Old Order M/C” and the demon skull with earrings shall be referred to as “Colours”. The Old Order M/C Colours was created by our founder Andre “STRETCH”
1.3 Supporter items will never have the Old Order MC appear on the back of any clothing item, and are never to be fashioned in such a way as to resemble Old Older MC members Colours.
1.4 The production and sale of items with the Old Order M/C Colours for members or supporters may be done to benefit the Old Order M/C, not any individual member(s).
1.5 Motorcycle Club Vest
1.6 All received must be put on to your respective halfie within 14 days of receiving of them.
1.6.1 Back of the vest (halfie):
1.6.1.1 The top of the top rocker will be placed 5 Centimetres from the top of the neck seam. The Old Order will be spaced 1 centimetre below the top rocker and one inch above the nick name. This is required to keep all vests uniform.
1.6.1.2 No other patches, pins or other decorations are allowed on the back of the vest between the side seams.

- OBJECTIVES
2.1 To provide members with the opportunity of exchanging information and maintaining useful contact with other motorcyclists.
2.2 To inform members of matters of interest to motorcycle owners.
2.3 To promote the good image of motorcycling in general and that of the riders of the Old Order in particular.
2.4 To create a support network for club members around the country.
2.5 To help and educate others who require training on how to ride a motorcycle correctly.
2.6 To provide a breakdown/emergency fund to members only.
2.7 To have as much fun as possible.
2.8 To assist in the fund raising for valid charities
2.9 To assist in the communities where each region is stationed.
- MEMBERSHIP
3.1 Full Membership shall be open to anyone who was invited and gone through his/her prospect period successfully being of minimum age of 18 years old. This membership is for life.
3.2 Prospect. Is a person who has been invited by a full member and has been approved by the president. A person who is younger than 18 who has a valid learners licence to ride a bike of his/her own as part of Old Order may wear a prospect patch, with their prospect period starting when he /she turns 18 years old. The prospectship shall be set out by the president at the beginning of the time period.
3.3 Founder member: is a person who started the Old Order MC where all ideas for the club originated.
3.4 Honorary Member : is a person who has passed through the ranks of the Old Order and passed his/her title on to another upcoming member or has done outstanding service as a member
3.5 Associate Rider shall be open to :
3.5.1 Anyone who regularly rides with the Old Order motorcycle club members and who is not a member of another club.
3.5.2 Anyone who is a full member of another club who rides regularly with the Old Order.
3.5.3 Anyone who is a pillion and is or is not a member of the Old Order.
- INVITATION FOR MEMBERSHIP
4.1 All invitees, supported by a proposer and seconded, both being full members of at least one year’s standing, and approved by a regional or national president.
4.2 Invitations for membership shall be dealt with in the following manner :
4.2.1 The invitation by a Full Member shall be considered by the president after the invitee has attended at least one rally together.
4.2.2 The invitation to an Associate Member shall be considered through normal channels, after the invitee has been invited and gone through the resignation period of his/her respected club.
4.2.3 Any member shall have the opportunity to object to the invitation, the president in which event, shall have the power to interview such objector privately.
4.2.4 The President shall, nevertheless, be empowered to refuse or admit any invitee at his sole discretion.
- RESPONSIBILITIES FOR MEMBERSHIP
5.1 All rally entrance fees shall be the responsibility of each member at the entrance of each event.
5.2 Payment of the entrance fees shall entitle the member, upon acceptance, to receive whatever the rally organizers deem fit.
5.3 Any loans or cash assistance will be paid back to the Old Order in the time arranged. A guarantee for the payment must be agreed upon.
5.4 Membership will be terminated forthwith upon anyone disrespecting the “Old Order” or any other club…
5.5 Any person, whose membership has been revoked, may not wear or represent the “Old Order” in any way.
5.6 All members must make effort to attend and assist in any rally presented by the Old Order
5.7 “FLAG” The flag will be treated with respect and not misused. The flag bearer will ensure the flag is kept with the Old Order members at all times. Kept safe and out of harm from other clubs. Flag will not be waved in an insulting way to any other club.
5.8 “ÖATH” each member will repeat an oath to the Old Order and its members which will remain his duty to stand by this oath as a member or as a member who has resigned or requested to hand in his .
- VOLUNTARY RESIGNATION OF MEMBERS
Any member whose subscription is not in arrears and who desires to resign his or her membership shall tender his or her resignation by notice in writing given to the Secretary. The tender of such resignation shall be dealt with by the General Meeting held after the expiration of seven days from the receipt by the Secretary of such notice. On acceptance of the resignation the member shall cease to be a member and so forfeit all rights and privileges of membership. All patches and Colours relating to the Old Order will be returned in good condition. This person may only rejoin another motorcycle club after a period of 6 months has elapsed.
- GENERAL MEETINGS
7.1 Only full members in good standing shall be permitted to vote at a General Meeting, and no vote may be cast by proxy.
7.2 A quorum shall consist of … In the event that there is no quorum, the meeting shall be adjourned for a period of fifteen minutes, and then failing a quorum, the meeting shall stand adjourned for a period of one week whereupon the members present at such meeting shall form a quorum.
7.3 Voting shall be by means of a show of hands …
7.4 The Club shall hold an Annual General Meeting within 2 months of the rally to be held.
7.5 The Constitution of the Club may be amended by resolution on a two thirds
Majority of any General Meeting.
7.6 A Special General Meeting may be called by the regional presidents or national president, or upon requisition …
- LIABILITIES
8.1 The liability of members shall be limited to …
8.2 The Club shall in no circumstances whatsoever be held liable for any loss or damage to property of any member or guest whether occasioned by negligence, theft or otherwise, neither shall the Club be liable for personal injury or harm suffered by any member or guest.
8.3 Any member introducing a guest shall be responsible for the conduct of such guest.
8.4 The Club reserves the right to suspend or cancel the membership of any member who is considered, in the opinion of the President, to have acted contrary to the interest and aims of the Club.
- Old Order Privileges
9.1 To wear their Colours with pride…
9.2 Include their region name on all notices, flyers and calendar entries of events, fundraisers, raffles, etc.
9.3 Make application for bike breakdown/repair loan (approval by national president)
9.4 To ride to any rally he/she wishes under no duress.
- EXPULSION OF A region / member
10.1Any member who alleges that a region/member is conducting itself in a manner that conflicts with the Old Order Motorcycle Club Constitution and must send substantiated proof of such allegations to the regional President and national president.
10.2The national president and founder members (the Committee) will proceed with the possible expulsion as follows:
9.2.1 The regional President will have a discussion with its general membership about the allegations.
9.2.2 If the allegations cannot be substantiated a letter will be sent to the accused regional President/member informing him of the allegations and that they cannot be substantiated.
9.2.3 The allegations will be provided to the region/member in question by means of a written notification. The accused region will have (30) thirty days to contest the accusations.
9.2.4 If the allegations can be substantiated, the guilty members are required to be expelled.
9.2.5 If the Committee were to expel a region/member, written notification by means of a certified letter with return receipt will be sent to the President/member of the expelled region/member indicating expulsion and the rationale thereof.
9.2.3 When formal expulsion from the Old Order MC is mandated, the expelled region/member will:
9.2.3.1 Cease and desist from the Old Order MC
9.2.3.2 Forfeit their patches and any Old Order MC property to the National President within (30) thirty days of expulsion notification.
9.2.3.3 Will have no right, title, interest or claim in any assets of the Old Order MC.
9.2.3.4 Relinquish any rights to a refund of fees or contributions by the expelled region or member..
9.2.4 If the expelled regional President/member fails to comply with the request to return any and all property owned by the “Old Order” within (30) thirty days, a criminal complaint with the state police of the expelled regions location requesting larceny charges be filed against the region’s President/member and or its general membership. No member from that chapter may transfer during the time of the allegations to another region to escape the pending decision of the wrong doings in that region.
